Shipment and Delivery
Section 1 Shipment.
Unless expressly agreed upon by the Parties in writing, the Seller shall determine the method and carrier for the shipment of the Goods.
Section 2 Delivery.
Unless otherwise agreed to in writing by the Parties, the Seller shall ship the Goods via a common carrier of the Seller's choice to the Buyer's address as provided in the Invoice.
Section 3 Late Delivery.
Any time quoted by the Seller for delivery is an estimate only. The Seller shall not be liable for any loss or damage arising from delays in fulfilling any order, failure to deliver, or delay in delivery. A delay in the shipment or delivery of the Goods does not relieve the Buyer of their obligations under this Agreement.
Section 4 Loss and Replacement.
In the event of a lost or stolen shipment, the Buyer must first file a formal police report and submit a claim to the shipping provider before qualifying for any replacement items. Documentation of both the police report and the shipping provider's claim must be submitted to the Seller within 10 business days of the reported loss.
If the claim is approved, any replacement items will be shipped exclusively to a designated shipping facility or hub for in-person pickup. Under no circumstances will replacement items be shipped to the original delivery address or any non-hub location. This policy is designed to prevent further losses and ensure secure delivery of replacement goods. The Buyer is responsible for coordinating the pickup of replacement items from the shipping facility within the provider's specified timeframe.
Section 5 No Right of Return.
Once Goods are shipped, they are deemed accepted by the Buyer, and no returns are permitted. If an order is canceled prior to shipment, a $250 reprocessing fee will be applied and deducted from any refund for a photo booth.
Orders paid via third-party financing are non-returnable and non-cancellable under any circumstances. No cancellations, returns, or exchanges are allowed unless the item is damaged upon immediate receipt. If the items are damaged upon receipt, the Buyer must provide visual proof of the damage within 7 business days in order to claim a refund. The delivery date is determined by the tracking information provided by the third-party shipping company.
